Because choosing the right lawyer is so important, there are several things you need to know about lawyer advertising:
- Personal injury lawyers are not allowed to advertise the actual results they have achieved for clients. But you have the right
to interview lawyers and to ASK ABOUT the results they have achieved in the past. In particular, you have the right to
ask about what type of JURY VERDICTS the lawyer has been able to get for clients. It is important to recognize that
each case is different. The results an attorney gets in another case cannot be used to predict an outcome for your case.
However, it is critical to verify that the attorney you hire has successfully tried large cases to a jury. Remember,
a lawyer can advertise on T.V. even though the lawyer has never achieved a large verdict for a client in a personal
injury action. Ask yourself this question: Would I rather have an attorney who has achieved multiple million dollar
verdicts for his or her clients or a lawyer who has never achieved even a one hundred thousand dollar verdict for his or her clients?
- Just because a lawyer or firm advertises on television, billboards, etc. does not mean the lawyer or firm is more
successful or more experienced. It may simply mean that they have hired good media consultants.
- Many lawyers and firms that advertise extensively handle an extremely large case load, and often assign paralegals
to a large portion of the actual work on the case.
- Any lawyer or firm can advertise as "personal injury attorneys," even if they have little or no experience handling
serious injury or death cases, and even if they practice primarily in other fields of law.
