Gonderman Legal has always stood for one thing above all
else: honesty and integrity in representation of people who have been
seriously injured as a result of another's fault.
We have helped establish these important points of law
in Indiana on behalf of people injured by the fault of another:
- People injured in Indiana are entitled to recover damages for the nature and extent of their injuries
as they affect their ability to function as a whole person. This means, for example, a person who cannot
engage in certain recreational or other activities because of their injuries is entitled to recover damages
for this loss. Canfield v. Sandock, 563 N.E.2d 1279 (Indiana Supreme Court 1990).
- Defense lawyers are not permitted to discuss an injured person's medical history or condition with the
injured person's physician outside of the presence of the injured person's lawyer. This allows the injured
person's lawyer to protect the injured person's private, privileged medical information from disclosure. Cua
v. Morrison, 636 N.E.2d 1248 (Indiana Court of Appeals 1994)
(Gonderman Legal was amicus curiae for Indiana Trial Lawyers Association in this case).
- When an injured person receives worker's compensation benefits and also recovers damages under an
uninsured or underinsured motorist's policy which excludes payment for medical bills and lost wages paid
under worker's compensation, the injured person does not have to pay back the amounts the person received
under worker's compensation. This allows an injured person to recover all his or her damages without having
them unfairly reduced. Walkup v.Wabash National Corporation, 702 N.E.2d 713 (Indiana Supreme Court
1998) (Gonderman Legal was amicus curiae for Indiana Trial Lawyers Association in this case).
- When an injured person files a lawsuit and is required to undergo an independent medical examination,
the examination may be tape recorded so that an accurate record can be made of the examination. This can
help ensure the examination is fair and independent, instead of biased against the injured person. Jacob v. Chaplin,
639 N.E.2d 1010 (Indiana Supreme Court 1994).
- Defense lawyers cannot obtain an injured person's medical records directly from the injured person's
medical providers without a Court order. The injured person's lawyer must be given an opportunity to
protect private, privileged medical information from disclosure. This helps insure that only relevant
medical records are disclosed in the personal injury lawsuit. Canfield v. Sandock, 563 N.E.2d 526 (Indiana Supreme Court 1991)
Gonderman Legal Corporation is a different kind of law firm. We invite you to consider how we might be able to help you.
